A message from Troy Davis

I was asked to publish on Newsvine the following letter from Troy Anthony Davis, with a forward from his sister, Martina Correia.

For those who haven't been following: Troy Anthony Davis was scheduled for execution in Georgia last week. The Supreme Court of the United States granted him a temporary stay of execution until they decide whether or not to hear his Eighth Amendment challenge to his death sentence. For more background, see Georgia Prepares to Execute Man Who is Probably Innocent, and the various Troy Davis items published on my column.

____________________________________
Below you will find a message my brother Troy mailed to me on September 22, 2008 the night before his scheduled execution in Georgia, it was for all the people who believe in Justice and in him, so I hope you get a small glimpse of what Troy's spirit is really like.

Martina

To all
This is a message from Troy Anthony Davis

I want to thank all of you for your efforts and dedication to Human Rights and Human Kindness, in the past year I have experienced such emotion, joy, sadness and never ending faith. It is because of all of you that I am alive today, as I look at my sister Martina I am marveled by the love she has for me and of course I worry about her and her health, but as she tells me she is the eldest and she will not back down from this fight to save my life and prove to the world that I am innocent of this terrible crime.

As I look at my mail from across the globe, from places I have never ever dreamed I would know about and people speaking languages and expressing cultures and religions I could only hope to one day see first hand. I am humbled by the emotion that fills my heart with overwhelming, overflowing Joy. I can't even explain the insurgence of emotion I feel when I try to express the strength I draw from you all, it compounds my faith and it shows me yet again that this is not a case about the death penalty, this is not a case about Troy Davis, this is a case about Justice and the Human Spirit to see Justice prevail.

I cannot answer all of your letters but I do read them all, I cannot see you all but I can imagine your faces, I cannot hear you speak but your letters take me to the far reaches of the world, I cannot touch you physically but I feel your warmth everyday I exist.

So Thank you and remember I am in a place where execution can only destroy your physical form but because of my faith in God, my family and all of you I have been spiritually free for some time and no matter what happens in the days, weeks to come, this Movement to end the death penalty, to seek true justice, to expose a system that fails to protect the innocent must be accelerated. There are so many more Troy Davis'. This fight to end the death penalty is not won or lost through me but through our strength to move forward and save every innocent person in captivity around the globe. We need to dismantle this Unjust system city by city, state by state and country by country.

I can't wait to Stand with you, no matter if that is in physical or spiritual form, I will one day be announcing, I AM TROY DAVIS, and I AM FREE!

Never Stop Fighting for Justice and We will Win!

A request from Martina:

One thing we need to keep is the Media in this story so please to everyone please post comments to CNN.com, CBS.com and make comments on the Troy Davis stories and email other national, state and local media where you live and tell them we want to know more about the Troy Anthony Davis case. One element I have noticed missing in all the , media outlets is that no one mentions that the Anti-terrorism and Effective Death Penalty Act is invloved, and that is why Troy's case has got to this point. So we want to encourage the media to talk about law and how it does not protect the innocent by limiting the appeals process. If the media knows we want to know more they will do more stories on this case. So get you emails going to all national media. Continue to write op-eds, this is a case of innocence not just the death penalty, eyewitness identification, witness recantation and procedures of law.

Thanks

Martina

Here is something we can do to honor that request.  It's easy to do and takes no time.

Everyday going forward make a point to tell at least one person everyday the following:

"The mere existence of the death penalty ensures that innocents will be put to death."

That's it plant the seed in the minds of those around you whenever you can and wherever you can.  It's a statement of fact and cannot be disputed.  Doubts about a specific individual cannot be used to combat the simple logic of the statement, although you may have to deal with statements such as but if they were guilty they should be punished.  Fight any urge to argue such rebuttals or points by your listener.  Truth is truth, simply restate the sentence and walk away.

Ja Ragga:

found this in an article and thought it relevant, to your statement about the death penalty.

"Jeanne Woodford, the former director of the California Department of Corrections, is also the former warden of San Quentin State Prison, where she presided over four executions. She isn't soft on crime. Yet Woodford no longer believes that executions are necessary to society's safety. is pragmatic: life imprisonment is "cheaper -- much, much cheaper than execution." Yet she also confronts the ethical question:

To say that I have regrets about my involvement in the death penalty is to let myself off the hook too easily. To take a life in order to prove how much we value another life does not strengthen our society. It is a public policy that devalues our very being and detracts crucial resources from programs that could truly make our communities safe."

It's always interesting and far more compelling when people in authority who have such weighty responsibility as Jeanne Woodford as the Director of Calif. Dept. of Corrections did revise their positions on based on personal experience.  It's enormous support when those people speak up and for a real and substantive change.

She has been there and knows all the details many of which we on the outside of the correction system can really only guess at.  I have done and said some things I am not proud of myself, but I can only imagine the amount of remorse she feels today.  A powerful thing you've brought us with this comment Steve, thank you.

Vas,

Thanks for passing this on. He has been on my mind for days since your first post. I particularly paid attention to his mannor of speach. This is a man that has been beaten down and still standing, what a remarkable example of the fight and faith that should reside in all of us.

We will all face death at one point in our lives, but his ability to speak about his feelings of our support and if this doesn't save him maybe it will save the next is a man that has already dealt with his demons and is ready. The lack of selfishness in his words and his humility should tell everyone this is worth a second trial.

I can't imagine the hardship this man is going through, nor of those who so obviously love him. Well, I've come to know something of the man, not everything, blessedly, but enough to inform myself of suffering.

I was going to post something about some related issues within myself that Troy's case has brought to the surface. It occurs to me that many of us might be struggling with some of these same issues and perhaps a thread to ventilate about those issues would be helpful to all concerned. I am going to take the comments I was going to post here and write an article instead. Call it Troy's Troops Group Therapy or something of that nature. This has been such an intense two weeks for us. Maybe we will all benefit from having a place to ventilate issues that may not be completely appropriate on our update articles. I'll let all know when it is done.

Validation Therapy for Troy's Troops - Inner Conflicts Revealed/Discussed

I just want to point out that this forum will be for anyone to ventilate any issues they may be experiencing as a result of Troy's case in an environment that is non-judgmental and empathetic. I'll tolerate no less. We all struggle with inner conflict at times. I think Troy's case may be stirring inner conflicts that some of us may not even have been aware that we had. Troy's case may also cause reopening of individual wounds that we thought were healed long ago, especially among those who may have been victims of crime in the past even thought they are fighting for Troy now. The thread is meant to be a safe haven to discuss these issues.

Troy's resilience in the face of injustice is a lesson to us all. I just want to make sure I have this straight...he is probably innocent, he has been sentenced to death, he has arrived at the brink of death more than once, the system has refused to acknowledge the evidence of his innocence, the warden has punished him for talking about his innocence and has prevented him from seeing or talking to his loved ones in the darkest of hours, the parole board tried to execute him before the Supreme Court could hear his appeal...

...and yet Troy spends his time encouraging us to be strong.

David C. Kanz
sorry jbdaad----had a tough day at work today... : )
Kyanna:re registration initiatives: yes there are---but I am afraid this is the old south----the county has become an "escape" for folks who lived in Florida---due to insurance and hurricanes---and the white populas doesn't let go of power too easily. What I am trying to say is----the black populus fears (with cause) and is dependent on the whites economically. It really is like being transported back in time.
The racism is hidden well publicly but believe me---we are not "out of the woods" down here so to speak with regard to racism. It is real. It is potent. It is dangerous. (I have been threatened by whites publicly.....a damn yankee...)
My step dad has been a civil rights activist for many years----and as a city councilman helped make it possible for city government to begin to hire black people---and that was only 15 years ago----yes only 15 years ago---and it hasn't gone very far since! In the particular instance, he "encouraged" (in the interests of diversity) the city to hire its first black asst. Fire Chief back then---so he could be in a position where he would be up next for the Chief position.
Jump forward to last year when the white Fire Chief retired and the black assistant was ready to fill the post---HA!----the city wasn't even going to consider him until we put together a statement re the intent of the former city council members re the Asst. Chief. My step dad took the statement to the city council---that night packed with 300 people in attendance in a room that seats 50-----it was GREAAT!My step dad received a standing ovation from the audience--and the black Assistant Chief was hired as the Chief----HOWEVER---less than a year later the new Black Fire Chief resigned----And you can guess why.......we were so disappointed---but the discrimination was just more than the poor guy could bear.
I think he actually feared for the well being of his family---but of course would NEVER say such a thing here anyway....Welcome to SW Georgia, USA----and the letter from Troy's sister tells the story here as well...
And I have many more...like stories.
I think we do not get much attention down here for such acts because it is one of the poorest counties in the State of Georgia, quite frankly.
One block away from my house is a street that still has old slave shacks---yes actual honest to god 10 by 10 slave shacks---in which several generations of the same family have lived since they were built----
Don't get me started!!
And BTW---if Troy Davis were white we would not be having this discussion---he would have been exonerated a long time ago.
So goes Republican politics in Georgia----and unfortunately---alot of Democrats as well.

Free to go-- North Carolina Frees Innocent Prisoner After Seven Years in Prison

Perhaps most troubling was prosecutors' failure to follow through when told that someone else -- a federal prison inmate who matched the victim's description of the suspect -- had confessed. The impression left by such lack of initiative is that for some authorities in Durham, once a conviction is obtained, there's no further obligation to make sure justice is done.

blockquote>

This is from a story by irnuocon. Fits pretty close with the selfish practices going on in Troys` case.

  How's it going Vas?

You and I are in agreement I this general issue as you well know. Having the death penalty here in America in this day and age is barbaric no matter the cause. Our justice system is a joke and seems hell bent on becoming tougher instead of studying the problem to figure out a fairer and more holistic system that regards human rights. Hell they still use the electric chair and if that doesn't frighten us then I just don't know what will.

Keep fighting the good fight and I will talk to you soon!!

Great to see you here, Forest!

Yup, we could build a much fairer society with more opportunity and inclusion, just as you say, but that would mean some of the haves would have to have less.  That's really what it boils down to.  How can you be surprised when we have a culture where people don't stop to help when they witness a serious car accident?

Thanks Vas for bringing this very very tragic case to me and others at Newsvine that might have been unaware of it.
There is huge potential for error and negligence when it comes to capital cases like this which involves the use eyewitness accounts. Eye witness accounts are always problematic. This is even more so when there is little or no other evidence to speak of. There is also serious issues when it comes to the defence of the defendent in capital cases and the way the trials are conducted with differences in the trial and the sentencing part...

For the arrogance of "officers of the court" to cloud the halls of justice is criminal in itself.

To manipulate, alter and / or ignore evidence when human life is at stake is criminal.

When "officers of the court" who's soul purpose is to interpret and administer the "LAW" are so quick to turn a blind eye to the truth, therefore the LAW and the Constitution is criminal.

How can ones arrogance be so overwhelming that they would allow someone to be incarcerated and even executed when they know the person to be innocent?

This is what burns my ass. Time and again, we have heard of evidence surfacing that exonerates people - and I can think of quite a few cases in which race was not really involved - yet these D.A.s and prosecuting attornies lack the personal depth of character to admit to their own mistakes, or, sometimes, their outright wrongs even in the face of overwhelming evidence.Just as disturbing as the unwillingness to admit they convicted the wrong man, is their willingness to allow the innocent to suffer for these crimes that they never committed all in the name of saving their own reputations. That represents, to me, character so bad that I would not trust one of them to dog-sit for me.

I need to add something to this: I have also seen cases where the prosecuting attornies AND the investigating officers rallied to get wrongfully convicted persons freed, too. That, my friends, IS character worthy of emulation!

In ragard to your comment on the character issue.

Do you think DA's get paid more for felony covictions as apposed to misdemeaner convictions?

There being the reason for lack of character?

Success as a DA is a sure path to political position, so conviction rate is critical particularly in the south.

No I don't think that at all. I think pathetic haracter develops primarily in childhood. And I don't believe all DAs have dangerous character flaws. Those who, in the face of overwhelming evidence of an accused's innocence, continue to insist the accused is guilty have a dangerous character flaw of not being able to accept their own shortcomings and admit their errors. Even worse are those cases similar to the Duke Soccer tragedy. That bastard was willing to send 3 innocent kids to prison just to promote his own career aspirations. Just how self-centered and evil can one person be and still be able to look in the mirror every morning?

Ms Belle:
If your interested in a case that will blow your socks off, that is just 60 - 70 miles north of ya, lookie at this.

Not only did the prosecutor fail to present any evidence to support his fabricated theory, but the judge has "apparently" lied about blank verdict forms so to ignore and suppress a unanimous not guilty verdict.

To the Davis family, forgive me for posting this case, but it also proves that this does happen, more than people know about.

Steve, I heard bits of this locally in the Courier Journal. I'm so sorry! Give me time to get awake and I'll write an article on this so we can organize on another thread and leave this one for Troy.

No D.A.'s are paid a flat salary, so when they are trying to rack up a won/lose record with class A felonies as the main trophy, it is not a strive for extra money as compared to their arrogance and "their" inability to admit when they have erred in a case that brings the character issue to the forefront.

What drove M. Nifong to railroad the 3 college students?

Is it not an extreme lack of character if one is willing for another to be put to death or incarcerated if there is ANY question of innocence?

While Mr. Davis's case proceeded through the courts, the budget of the Georgia Resource Center stated in an affidavit that, "We were simply trying to avert total disaster rather than provide any kind of active or effective representation."

I believe aless was referring this or a similar article regarding Troy Davis' case.

http://www.acsblog.org/criminal-justice-finality-over-fairness-the-troy-davis-case.html

Excerpt from the article:

It also appears that the quality of legal representation Mr. Davis received during trial was, by his own laywer's account, seriously deficient. Whle Mr. Davis's case proceeded through the courts, the budget of the Georgia Resource Center stated in an affidavit that, "We were simply trying to avert total disaster rather than provide any kind of active or effective representation."

That's pretty damaging stuff.  Nice find on aless' part.  Well done aless.

Sorry for the confusion.
The source is the blog entry recently posted (October 2nd) by William S. Sessions, (former FBI director and advocate of the death penalty) for the American Constitution Society for Law and Society.  He provides insight into some of the legal problems Troy has encountered throughout his case.
