I will be updating this article with the latest of Troy Anthony Davis' situation. Unless either the Georgia or US Supreme Courts intervene, Troy will be executed at 7pm tomorrow — Tuesday, Sept 23, 2008.

For those who haven't been following: Most people believe he is innocent, or agree that because of witness recants after the trial, more than enough doubt exists to make execution without a retrial a grave miscarriage of justice. To learn more about the details, you can read
I spoke with people close to Troy's family last night and early this morning. I could not interview his family directly. They have no choice but to assume the worst, and are spending the last hours of Troys life with him as much as the prison allows.
Here is the up-to-the-minute status:
The Board on Saturday refused to reconsider the matter and said that that decision is absolutely final.
The Georgia Attorney General's office has been asked to investigate the allegations of serious mishandling of Davis' murder prosecution by both the Savannah Police Department and the Chatham County District Attorney's Office. So far the AG has ignored such requests. Issues of conflict of interest have been raised, since the Attorney General is also the legal representative of targets of these allegations.

A delegation attempting to deliver a letter to Attorney General were forcibly prevented from doing so by the Capitol Police.
There is an appeal appeal before this court. It last ruled against Troy was 4-3, but people I spoke to believe that they handed it down assuming that he'd be granted clemency. Only one justice needs to switch her or his vote for a stay, a possibility given the Board of Pardons and Parole's refusal to grant clemency. Word from the GA Supreme Court is expected today.
UPDATE - Mon 5:41 pm Eastern
The Georgia State Supreme Court has ruled that it does not have jurisdiction to decide the appeal. They defer to the US Supreme Court. I am told that this wasn't a surprise. Unless there is some unexpected about face from the Georgia's Board of Pardons and Parole, which is unlikely given their adamant refusal to reconsider any new evidence, the matter now rests entirely in the hands of the US Supreme Court.
I will update this with more detail as soon as I get it.
The US Supreme Court has not yet agreed to a hearing, as the 29th is the date they officially reconvene. Troy's case is on the docket along with an unknown amount of other cases. The justices could choose not to hear the case or issue a stay. That aside, the most immediate concern is that they reconvene 6 days after Troy's execution date. They would have to be convinced to take special action prior to reconvening.

At least they're aware of it and being proactive in terms of gathering and reviewing the information. The good news here is that it is being ruled on based on the evidence, and not the AEDPA or procedural grounds.

UPDATE - Tue 2:50 pm Eastern
Confirmed. After many calls to the Court resulted in responses of "There is no information at this time, we'll get back to you", which I interpreted as contradicting Glenn Weintraub's report, I finally got a "Yes, they are meeting right now." I wasn't able to extract any other information. From her use of "they", we can deduce that the entire court rather than Justice Thomas is looking at it.

The US Supreme Court decision to stay the execution was unanimous.
Troy's family and supporters feel that Georgia, with its history of flawed justice for its black citizens, is unlikely to stop the execution on their own. Besides a stay of execution being granted by either Supreme Court, the only hope is that national news coverage exposes the flaws in the case and the fact that there is reasonable doubt about Troy's guilt. Such coverage could be embarrassing enough to Georgia to force them to grant a retrial.
But there has been zero national television coverage. There has been minimal coverage in papers outside of Georgia — Bob Herbert's New York Times article is the only one I know of.

A problem we're facing is that media outlets are hesitant to cover it simply because the prison won't give them access to Troy. I know CNN was interested, but they wouldn't allow an interview. So yes, we need to keep pushing it.
Supporters of Troy are being asked to contact the news divisions of the television networks and the cable news channels, to ask them why they are not covering this case.

Georgia is packed to the brim with corrupt Republican lawmakers, there's no way this man will live and it deeply saddens me.
Vas, I e-mailed complaints about the story not being covered to every TV news network except CBS - for some reason I keep getting a message that CBS can't process the "contact us" request. May I suggest also e-mailing the individual newscast shows scheduled to broadcast this evening and in the morning. Those usually have a separate mailbox in addition to the network mailbox. Forget print news. No time for that.
Also if the Governor gets a slew of out of state e-mails, he might get the idea that America is watching this injustice even if Georgia is preventing media interviews to discourage media coverage.

Just called them. I was polite the entire time! promise!
First lady that answered told me to call back tomorrow, and I can then ask why it wasn't covered today. I told her I think tomorrow will be too late, Troy Davis will be executed tomorrow, and it should be on the news today. She responded "News? oh you need the news department for that, please hold while I transfer you".
The next lady was also nice. She said they have been receiving a lot of calls regarding this topic (keep up the good work!) but that every hour has its own producer, and they decide what they cover. She said she is hopeful one of them will pick it up, or someone somewhere out there in the news will pick it up.
I responded by reminding her that an innocent man may be executed tomorrow, and that would be a grave injustice. That it is Un American for us to kill an innocent man. I asked her to please let her supervisors know that this is a very important story and that they need to cover it today, tomorrow is too late.
She told me they have received news footage from their affiliate down in the Georgia.

Allow me to suggest also e-mailing McCain's campaign and expressing the opinion that this execution reflects badly on him and the Republican party. Do it politely or it'll go into the crackpot file. I've already done it and asked him to intervene to prove otherwise.
Please excuse the intrusion but I just wanted to state very clearly that not all Republicans are pro-death penalty. I'm a Republican and I vehemently oppose this practice. Our justice system is seriously flawed and since mere mortals adjudicate it....we should abandon it NOW.
My voter registration reads "Republican" too, Katie, so I do know and did not mean to imply otherwise. I'd like to rally both sides of the aisle to e-mail McCain's camp and politely point out that this can be used against the Republican party and ask him to make a statement or intervene in some way. Every move a candidate makes WILL make the evening news and attract attention to Troy's case.

I absolutely agree. I understand the visceral feeling towards revenge for the likes of David Westerfield who murdered little Danielle VanDam and then threw her broken and abused body to the coyotes. But...I still cannot support the death penalty. I don't know what, if anything, Senator McCain can do but I did send an e-mail urging a stay and a full accounting. Do you know what Senator Obama has done? I admit I've not followed this case being out here in Grand Canyon land.
I'd like to suggest to anyone who hasn't already seen it, to watch "The Exonerated". Strikes at the heart of everyone's liberty. It should not be an issue of being a democrat or a republican. We all claim "justice for all".

Here is the number to Senator McCain's office in D.C. 202-224-2235. I know Mrs. McCain, she has been in my classroom. I can't say she is more than an acquaintance but she went way out of her way to thank my third graders. No politics involved. She was gracious in every way.
I did put in a call to the office and left my name and my history with Mrs. McCain. Hopefully, someone there will act. I pleaded with them to act on behalf of of Troy. I've called everyone else the good people here have listed. E-mailed even Forbes Magazine. Please let me know what else I can do. This is a travesty and every American should be outraged. We are supposed to be a nation of laws.

I have emailed NBC, I don't know if it will make a difference but I feel I have to try. I am in the UK and find it terrible that capital punnishment still goes on in a society like yours. Troy and his family are in my thoughts and I hope that he gets the opportunity to get the justice he deserves, this case is heartbreaking, I really cannot understand how the State of Georgia can get away with what is clearly racially motivated cold blooded murder. If the execution goes ahead, every person involved will have blood on their hands.

Kyana, I agree. The media is a good idea, but we don't have time. I think the best idea is to keep writing the GA attorney general and US Attorney General..both have power ABOVE the GA Parole Board and can stop this. If they see that many people OUTSIDE of georgia are saying something, they hopefully will get scared and stop the execution AT LEAST until the 30th of Sept when case is supposed to go to Supreme Court.

I was thinking the Attorney General's Office, too. I work for my state's, and I know the last time we had an execution, we got mail from all over the world about it.
I also remember a couple people had to stay at the office until the time of execution, in case the Governor called for a stay of execution. Then the people from my office had to call the prison and relay the message.
I sent Ian Walter's an e-mail asking if we can quote his boycott of Georgia article. If the governor gets a flood of e-mails citing this article, he'll know that people are paying attention to the call to boycott everything Georgia. I'm waiting to hear back from him. Does anyone have a way to contact him faster than via e-mail and get permission?
I would think that a call to boycott an entire state would interest the media, as well.

TRUST me, I know that this works:
Call anyway, EVERYONE. Even though they will spout the same tired line, KEEP CALLING BACK. It isn't whether they CAN do anything, it's whether they WILL do anything. They are instructed to respond to our calls like that.
They expect to get calls like this from time to time. BUT, they will short circuit if they are inundated with calls ALL DAY LONG about the same case/person, by MANY different people. Remember to tell them WHERE you are calling from too! The sheer fact that they will be answering the phone all day about the same case from all over the country will cause them to bring it to someones attention.
Once they realize that the calls are not going to stop, they WILL notify someone in authority. They will also start looking at the case, as the amount of calls will cause them to HAVE to familiarize themselves with the case. So keep it up! KEEP CALLING the State & Federal Supreme Courts! No matter how many times they say the same thing!! They may say they can't do anything, but I guarantee that they will be looking at it behind the scenes.
Call the 2 Supreme Courts and the State Attorney General. And DO NOT STOP!

Rachel Maddow mention Troy Davis' story on her MSNBC TV show yesterday. Keep up the good work. I'm going to email all the major news outlets.
She just announced the stay of execution just now as well, citing the facts that 7 of the 9 original testifiers against him have since recanted their testimony, and that the case lacked any evidence of a weapon, fingerprints or DNA linking Troy Davis to the crime. That's our girl!
Gosh, all this is so heartening! That's the encouragement Troy needs. As long as it is kept in the public eye.

Al Sharpton met with Troy on Saturday night. They prayed together, and then he held a press conference in front of the prison. But I'm not sure about Jesse Jackson. Great ideas!
Can I suggest that someone try to contact Mr Davis' attorney, if anyone can tell you who it is that would be best to contact, it would be him. I'm not sure about how to go about getting in touch with his attorney, however, I believe to do so would get you alot farther.

VAS, he is asking what Troy's defense is recommending as the best actions for Troy's supporters to take right now in his behalf. What is Troy's defense team suggesting as most helpful to the cause. They should know better than anyone.

Comments posted by arcanebliss laying blame on Republicans is completely wrong. The facts are, the Georgia State Board of Pardons and Paroles denied this man Clemency. Georgia is one of only three states where the Governor (a Republican) cannot grant clemency.
Any efforts should be directed at the Parole Board. A list of board members is here;
Parole Board has issued a new statement today pretty much in response to the public outcry but the language of the statement makes it clear that they are digging their heels in.
They would be better served by listing what they saw in their investigations that led them to that conclusions. That is my biggest problem with this is there is no explanation why decisions are being made against him. If I knew I might agree with them.
That statement only served to try to prove why we shouldn't hold the Parole Board accountable for his death.
Well, they are the ones making the decision to kill a man whose guilt has not been proved.
Innocent until proven guilty must not apply in Georgia. Funny, I thought they were a part of the US.
So, what Troy did wrong was to choose to live in Georgia, otherwise he wouldn't be facing death tomorrow.
Lest we forget... There is a victim and the victim's family and they, too, deserve justice. The execution of the wrong man denies justice to the victim, the family of the victim, and the innocent victim of the State of Georgia. While we fight to try to save Troy, let's remember the victim and his family as well.

I would suggest that you might want to consider posting information for contacting right-wing outlets. Like them or hate them - talk radio does reach a wide audience and McCain has as much pull as Obama (if not more by right of seniority in Congress and probably a greater network of contacts).
I admit hearing this side of the story makes me think a stay should be granted so things could be investigated further. However, I temper that with a lack of the other side of the story. In other words why hasn't a stay been granted all ready? Whats was the majority opinion of the Georgia Supreme Court ruling? Why isn't Jackson and Sharpton all over this - it is right up their alley. I have a hard time believing the media is staying away from this just on the basis of not getting access to Mr. Davis (surely they have access to his lawyers). All of that makes me think there is more to this than has been told within the past couple days here on Newsvine.
Also you might also want to post information on contacting the President - who of course also has the power to do something about this.
I can understand why you question this, and YOU SHOULD. Ask questions and by all means, dig deeper. The facts are the facts. I am a person intimately involved with this case, and I encourage you to read every legal brief and ruling you can get your hands on. If you have difficulty finding them, please let me know; I'm happy to supply it. This case is now based on the State's TWO witnesses who say Troy did it (one of whom is Sylvester Coles, who you should spend as much time as you can researching), and Troy's attorneys have NINE directly implicating Sylvester Coles. There was no physical evidence. None. So yes, please look into this as much as you can. There is absolutely nothing to hide, unless you're on the State's side.

I do recognize most reading this are not fans of the above, but the fact remains that getting on any of their shows gets you instant access to a large audience that tends to be more engaged than someone watching the news passively. Best case scenario is you may get one or more involved directly which will bring even more pressure to bear on the situation.
I don't know if this man is innocent or not. If he is, Pray to God for intervention.

Rachel Maddow mentioned the issue about Troy Davis on her TV show yesterday.
I got an e-mail response from Rachel Maddow. Unfortunately, in my sleep deprived haze, I sent it to the trash then deleted all JUST as I noticed it was there. I've sent a request to her plus my response to it and asked her to resend it all.
I asked her if she thought that Randi Rhodes would be interested and she said it's just the type of thing she'd love, so I sent an e-mail to her as well and said I would try to call tomorrow while she's on air. Maybe she'll ask the same questions we have been.
Anyway, I KNOW to tread lightly, but I have worked the system before. Not at this level, but I've gotten Judges here to stop hearing cases altogether regarding some issues and I got a friend's, (he became one after living with us and working with me. One of my "throw away homeless kids I told Seddeka about), $20,000.00 in warrants and such cleared with no jail time.
I DO know how to speak legalese. I work the legal system here a lot. So I'm just working things from the angles I've found worked best. I can speak to them in their own language.
Trust me, I'm not going to do anything stupid. NOW I'm going to bed, I have to get another x-ray in the morning and then get back to this and all the other irons I have currently in my fire.

Three of our four local news outlets carried the story last night! I've shot an email to a friend of mine at the fourth to see if they can squeeze it in. Our NBC affiliate even provided the website address for Troy's fight!
I've emailed and called Governor Perdue and encourage others to do the same. I've also sent out emails to my friends and family who are acting on this, as well. We have relatives in GA who are going to try working on this from a local angle, too.

What passion there is here! I just wanted to let everyone know that when I visited Troy yesterday, he was completely overwhelmed when I told him about this dedicated community. I told him about all of you; the comments, the debate and sharing of ideas as to how to expose this (his) tragedy and the many, many people who choose to show his face instead of their own. There is so much beauty and power behind that, and please know that he gets it. He is completely overwhelmed by this kind of grassroots support he so appreciates that everyone has come together in his name. He's honored and humbled, and it's because of all of you.
For Troy, let's keep going. You're all amazing, and as a close friend of his, I thank you from the bottom of my heart.

Elise, that's so nice of you to say. Do pass on that he has at least one supporter from across the Pond! I am rooting in my own small way because nothing like this should happen to anyone. His case deserves to be heard properly in the light of new evidence. :o(
Tell him to hang in there. We are certainly with him! It is wonderful when a community is brought together in situations such as this. It shows the power of what we can all do when it really matters. VAS, soon as I get some caffiene and meds in me, I'll be back to work on this. I dreamed we had troops marching into the prison to forcibly remove Troy from their custody and we had Colin Powell leading the charge. Weird how the mind works, huh?
